Coinbase Chief Policy Officer Faryar Shirzad attributed the Clarity Act’s recent failure to advance in the Senate to an unfavorable electoral calendar and a well-funded opposition campaign led by large banks. The bill, designed to establish clearer regulatory guidelines for cryptocurrencies, failed to secure enough support for a cloture vote this week.
Major banks spend $200 million to influence outcome
Shirzad highlighted a concerted effort by major financial institutions, which collectively spent approximately $200 million campaigning against the Clarity Act. He argued that this lobbying effort significantly slowed the momentum of the legislation as it made its way through Congress late in the electoral cycle.
According to Shirzad, the bill’s timing played a crucial role. Many lawmakers were reluctant to commit to controversial legislation just months before elections, which gave opponents an added advantage in shaping political sentiment around the measure.
Shirzad explained that the combined force of a late-stage legislative push and the financial sector’s costly campaign dealt a considerable blow to the Clarity Act, stating that Congress may have lost its chance for substantial crypto regulation this cycle.
Shift to regulatory actions and three-track strategy
With legislative efforts stalled, Shirzad believes that attention will now turn to regulatory agencies, including the US Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), and federal bank regulators under Chairman Paul Atkins. He suggested these institutions are likely to play a more central role in shaping the US crypto policy landscape in the coming months.
Shirzad also emphasized Coinbase’s continued commitment to a multi-pronged policy approach. This strategy encompasses legislative efforts, regulatory engagement, and advocacy for internationally consistent crypto standards.
He asserted that while the legislative route faces significant obstacles, regulatory and international initiatives still retain strong momentum, keeping hopes alive for increased clarity in the digital assets sector.
