A group of around 16,000 Chinese investors who lost their funds in Qian Zhimin’s crypto fraud have secured the right to appeal a UK court ruling that would have allowed the British government to retain most of the 61,000 Bitcoin seized from the scheme, currently valued at around $5 billion.

Legal battle over seized Bitcoin

The UK High Court decided on October 16 to permit the victims to continue pursuing compensation for their losses on the confiscated crypto assets. The group contested an October 12 decision by Justice Mark Turner, who determined that Chinese law, rather than English law, should govern their claims to the seized Bitcoin.

This legal distinction holds significant financial consequences. Under English law, claimants could be entitled to the full current value of the Bitcoin, capturing all dollar-denominated gains over time. In contrast, Chinese law restricts their compensation to the original principal and interest paid into the fraud.

The outcome could decide whether the billions of dollars in value gained by the Bitcoin since its seizure benefit the original investors or the UK Treasury. The conflicting legal interpretations have placed the fate of one of the largest cryptocurrency confiscations in UK history under international scrutiny.

Justice Turner cited that “the relevant damage occurred in China, the applicants parted with their money in China, and the alleged fraudulent representations were made in China,” as justification for using Chinese law in this case.

Justice Mark Turner emphasized that his ruling does not resolve the ultimate ownership of the Bitcoin, but it raises the burden of proof for the claimants, who must now demonstrate ownership according to Chinese law before seeking the return of assets through British courts.

Forfeiture proceedings in China

While the UK court process is ongoing, Chinese authorities are also making claims to the same pool of assets. The Tianjin Second Intermediate People’s Court stated on October 13 that it had accepted an application to forfeit Qian’s criminal proceeds, including 61,896 Bitcoin, various other cryptocurrencies, cash, jewelry, and investment holdings.

According to prosecutors, the property—seized by British authorities—stems from fundraising fraud that impacted more than 102,000 individuals and resulted in a total loss of RMB 19.98 billion. The court has granted a six-month window for affected investors to participate in the Chinese forfeiture proceedings. However, the Chinese order does not supersede the ongoing UK legal process, raising the possibility of jurisdictional conflict over the highly valuable Bitcoin wallet.

Background of the Qian Zhimin case

Qian Zhimin operated the extensive Ponzi scheme using Tianjin Lantian Gerui Electronic Technology between 2014 and 2017. Authorities reported inflows of approximately £4.1 billion into the fraudulent operation. Qian fled to Britain in 2017, after converting clients’ assets into Bitcoin. She later admitted to charges of fraud and money laundering and received an 11-year prison sentence in the UK.

Hok Seng Ling, a Malaysian national based in Derbyshire, played a key role in moving and laundering the funds. British authorities confiscated over £5.6 million from Ling, sourced mainly from seized cryptocurrencies, after his arrest. He was sentenced to four years and 11 months by Southwark Crown Court for his role in the operation, which included helping Qian evade law enforcement, organizing accommodation, and recruiting assistants.

Investor challenges and emerging crypto trends

The struggle faced by Qian’s victims highlights the complexities in global legal jurisdictions regarding digital assets. The overlapping claims between the UK and Chinese legal systems further complicate restitution for victims of cross-border cryptocurrency crimes. As courts deliberate over the future of these assets, monitoring both legal frameworks and investor initiatives remains essential.

Tracking trends and technical details, especially in fast-moving sectors such as meme tokens, can offer valuable insights. In the meme token market, an internet trend can transform into millions of dollars of interest within days. According to data shared by Fomo App, a trade involving “Niu Lai”—which turned an initial $99 investment into approximately $370,000—stands out as a striking example of this activity. In this market, tracking not only prices but also the timing and token choices of investors is crucial. The Crown Prosecution Service has maintained that victims can receive compensation through a process facilitated by Chinese authorities, while the UK proceedings determine the broader ownership rights over the seized Bitcoin.
