Class action lawsuit targets liquidation practices

A proposed class action lawsuit was filed in the U.S. District Court for the Southern District of New York against BitMEX on the same day the exchange announced its closure, scheduled for September 23. Plaintiffs BKX Services Inc. and David Namdar allege that BitMEX unfairly profited from forced liquidations, leading to combined losses of 622.66 BTC for traders on the platform.

BKX Services Inc. claims it lost around 305.81 BTC, while David Namdar alleges a loss of 316.85 BTC. The lawsuit centers on the contention that BitMEX’s systems gave the exchange a financial advantage in liquidating positions, particularly in high-leverage trading scenarios.

BitMEX maintains that allegations regarding liquidation mechanisms and preferential internal access have been reviewed before and found to be unsubstantiated, reiterating the company’s confidence in its current defense.

BitMEX closure highlights shifting crypto landscape

BitMEX’s exit comes amid broader shifts in the cryptocurrency sector, as earlier market leaders face regulatory tightening and increased competition. Once a dominant force in Bitcoin derivatives trading, BitMEX has lost market share in recent years and now faces mounting legal and operational pressures.

A similar fate recently befell Poolin, which was the world’s largest Bitcoin mining pool in 2019. Poolin filed for Chapter 11 bankruptcy following considerable financial difficulties, signaling further pressure on longstanding industry players.

Both scenarios illustrate how early pioneers in the crypto space are struggling to adapt as regulatory scrutiny and business pressures reshape the market.

As BitMEX prepares to end its operations, the legal dispute adds another layer of complexity regarding how the exchange handles liabilities and wraps up customer accounts in its final months.

The class action suit, filed just as BitMEX confirmed its closure, raises fresh uncertainties over the final stages of its shutdown and the way outstanding claims will be resolved.
