The Commodity Futures Trading Commission (CFTC) has initiated a lawsuit against Florida-based Goliath Ventures Inc. and its chief executive officer, Christopher Delgado, alleging the company operated a large-scale Ponzi scheme involving nearly $400 million collected from customers across the United States.

Details of the Alleged Scheme

The complaint, filed in the U.S. District Court for the Middle District of Florida, outlines accusations that Goliath Ventures and Delgado solicited funds from more than 1,600 individuals, promising profits through cryptocurrency trading, primarily in Bitcoin and other digital assets.

Instead of trading those funds as advertised, the CFTC contends the company misused all customer deposits. According to the agency, money from new investors was used to pay fake profits to earlier participants, while also financing Delgado’s personal luxuries.

Goliath Ventures reportedly provided account statements showing non-existent gains and assured customers their principal and profits would be returned. Such guarantees were designed to build trust and attract further investment, stated the CFTC.

Parallel Actions and Criminal Proceedings

Christopher Delgado has already admitted to criminal wrongdoing. In June, he pleaded guilty to related federal charges in a parallel case brought by the U.S. Attorney’s Office for the Middle District of Florida.

The Securities and Exchange Commission (SEC) also filed a civil action against Delgado and Goliath Ventures on the same day as the CFTC complaint, further escalating the legal response.

Goliath Ventures Inc. is a Florida-registered company that offered cryptocurrency investment products to the public, according to regulatory filings.

Regulatory Impact and Future Measures

CFTC Chairman Michael S. Selig described the enforcement action as part of a wider strategy to police fraud and promote legitimate activity in digital asset markets. Selig also indicated ongoing efforts to establish more transparent rules as the agency keeps watch over the sector.

David I. Miller, the CFTC’s director of enforcement, emphasized the agency’s ongoing role in countering digital commodity fraud. He framed the case as a demonstration of continued vigilance in protecting investors from schemes involving crypto assets.

The CFTC is seeking disgorgement of illicit gains, restitution for customers, civil monetary penalties, and permanent bans on trading and registration, along with an injunction against future violations of the Commodity Exchange Act and CFTC regulations.

The CFTC warned that collecting restitution in major fraud cases often proves difficult, as offenders may not have enough recoverable assets to repay their victims. The agency did not specify the legal counsel representing Delgado or Goliath Ventures in the current proceedings.
