The SEC outlined its intention to refine and clarify the regulatory structure for crypto asset custody by investment advisers and companies. The published proposal specifically seeks to update rules that the Commission describes as outdated, targeting regulatory burdens that no longer align with current market realities and technological developments in asset trading and management.

According to the rule submission, the revised framework would address how investment companies manage custody of digital assets, prioritizing enhanced investor protections while streamlining obsolete requirements. The SEC noted its goal is to ensure that regulatory mechanisms effectively reflect the rapid evolution seen in financial markets, especially as blockchain and tokenized assets become more common.

The proposal aims to clarify the framework for the custody of crypto assets for investment advisers and investment companies, as well as make other modernizations needed to remove burdens from certain outdated provisions that are no longer needed to provide investor protection given the evolution in the markets and security trading and holding practices.

Broader context and recent SEC initiatives

Despite the delayed progress on the Crypto Clarity Act, regulators at the SEC have continued to advance crypto-related policy changes. Earlier in the month, the agency began preparing an “innovation exemption” designed to permit 24/7 trading of tokenized stocks through blockchain technology.
