National Sheriffs’ Association drops opposition to Digital Asset Market Clarity Act

The National Sheriffs’ Association (NSA), which represents over 3,000 elected sheriffs across the United States, has announced it will no longer oppose the Digital Asset Market Clarity Act, moving to a neutral stance on the proposed legislation.

Shift in Position

NSA President Sheriff Troy Wellman of Moody County, South Dakota, and Executive Director Justin Smith formally conveyed the association’s updated position in a letter to Senate Majority Leader John Thune and Minority Leader Chuck Schumer. They explained that, due to the complexity of the legislation and ongoing debates over key details, the NSA now considers it best to “step back and allow the legislative process to proceed.”

The association decided that a neutral position would enable lawmakers to address outstanding issues and ultimately develop a regulatory framework that provides greater clarity for digital assets while balancing law enforcement needs.

The group’s previous opposition had represented a significant challenge for the bill, raising concerns over potential regulatory gaps related to digital asset transactions.

Concerns Over Section 604

In May, the NSA expressed apprehension to the Senate Banking Committee about section 604 of the Clarity Act, which would exempt decentralized finance (DeFi) protocols from money transmitter regulations. The association warned that such an exemption could allow mixers, tumblers, and DeFi platforms to sidestep anti-money-laundering (AML) requirements. The NSA highlighted risks involving evolving software, algorithms, and artificial intelligence potentially being used to move digital assets untraceably, facilitate money laundering, finance terrorism, and circumvent sanctions.

Mini dictionary: Decentralized finance (DeFi) refers to blockchain-based financial systems that do not rely on centralized intermediaries such as banks. Instead, DeFi protocols use smart contracts to facilitate peer-to-peer transactions and services directly on digital ledgers.

The White House responded by inviting law enforcement organizations to a meeting aimed at addressing these concerns, especially relating to illicit financing through new technology.

Next Steps for the Clarity Act

Despite the NSA’s change of stance, the future of the Digital Asset Market Clarity Act remains uncertain. The Senate has scheduled a key procedural vote on the legislation for September. However, Democrat-backed ethics provisions in the bill are still unresolved.

The House of Representatives announced last week that it would conduct its final votes before the midterm elections as soon as the Senate reconvenes. This move effectively closes the window for the Clarity Act to pass before November, casting further doubt on its prospects for becoming law this year.

Law enforcement’s withdrawal of opposition removes a key obstacle for the Clarity Act, but legislative and procedural barriers still remain ahead, particularly with major provisions yet to be agreed upon in Congress.
