David Schwartz, co-creator of XRP Ledger and current Ripple CTO Emeritus, has drawn a fresh comparison between Ripple’s ongoing legal challenges and a separate dispute completely outside the cryptocurrency sector. The executive recently commented on a high-profile case involving a private manufacturer and the state of Connecticut, which, in his view, mirrors regulatory tactics used by the U.S. Securities and Exchange Commission.

The comparison surfaced after American attorney Kostas Moros published details of a legal battle where a major manufacturer is contesting state legislation restricting the sale of specific product categories. According to case documents, the manufacturer claims the Connecticut attorney general’s office has refused to clarify criteria for determining which new product lines comply with the law, leaving companies uncertain about legal requirements.

Schwartz highlighted this issue on X, expressing concern over government agencies deliberately creating regulations that businesses cannot realistically follow. He stated that authorities are enforcing rules under which “you cannot possibly know whether you are complying with the law,” underscoring what he called the “grossly unfair” nature of these practices. He concluded his remarks with a pointed comment:

Schwartz noted that authorities at times force businesses to operate under ambiguous regulations, preventing them from ever being certain of compliance and exposing them to continuous legal risk.

The Ripple-SEC connection

When asked how he became so familiar with these tactics, Schwartz replied cryptically, “A little birdie told me,” directing attention to an Investopedia analysis of the SEC’s lawsuit against Ripple. The remark alluded to Ripple’s extended legal battle, in which the SEC has accused Ripple of selling over $1.3 billion worth of unregistered securities through the XRP token.

Defending itself, Ripple has consistently argued that the SEC failed to provide clear, transparent guidance on the classification of digital assets. This lack of regulatory clarity has been a central point in Ripple’s case, suggesting that the company operated under unclear standards, similar to those faced by the Connecticut manufacturer.

Broader implications for businesses

Legal experts have frequently cited the Ripple lawsuit as a significant precedent in debates about the limits and fairness of “regulation by enforcement.” For Ripple’s leadership, the years-long dispute with the SEC remains emblematic of the challenges private companies encounter when regulators do not offer explicit compliance criteria.
