IRS sets new rules on crypto charity deductions, details holding period, appraisal limits

In Brief

  • 🚨 IRS clarifies strict rules for crypto donations to charity, including new appraisal thresholds.

  • 💡 Only gifts to qualified organizations can be deducted; direct donations to individuals generally do not qualify.

  • 📈 The allowed deduction depends on holding period, asset valuation, and reporting requirements.

  • 📝 The IRS requires clear proof and documentation for any charitable donation in $BTC or other cryptocurrencies.

The Internal Revenue Service treats cryptocurrency donations as property rather than currency, which means a crypto gift to charity is generally considered a noncash contribution. Whether a donor qualifies for a federal tax deduction and the amount allowed depend on several factors, including the type of recipient, how long the asset has been held, valuation methods, and the relevant tax documentation.

Deduction criteria and holding period

To be eligible for a tax deduction in the US, crypto donations must be given to a qualified charitable organization. Contributions made directly to individuals, regardless of need, are not recognized as deductible charitable donations under IRS rules.

For digital assets held for more than one year, donors are typically allowed to deduct the fair market value as of the date of the donation. If the asset was held for one year or less, the deduction is the lower of either the cost basis or the market value on the day of the gift. Documenting the exact date, value, and quantity of the donated cryptocurrency is required due to the asset’s price volatility.

The IRS provides guidance explaining that, unlike cash donations, gifts of digital assets require comprehensive records. Required documentation includes the token’s name, quantity, date and time of transfer, transaction records, acquisition details, and a formal receipt from the recipient charity. Transaction fees cannot be included in deduction calculations.

Appraisal requirements and reporting thresholds

The value of the contribution and the forms required to support a deduction vary based on the amount. For noncash contributions of $250 or more, donors need a contemporaneous written acknowledgment from the charity. When claiming a deduction over $500, IRS Form 8283 must be filed. If the amount exceeds $5,000, a qualified appraisal and completion of Section B of Form 8283 are necessary. For deductions above $500,000, the appraisal document itself must accompany the return.

IRS rules also generally do not classify digital assets as publicly traded securities for appraisal purposes. According to IRS Publication 526, this distinction means a public exchange price typically does not eliminate the requirement for a formal appraisal at higher contribution thresholds.

For digital assets donated to a qualified charity, the length of time the asset is held directly impacts the deductible amount. In general, if the crypto has been held for over a year, the deduction is based on fair market value. If held for one year or less, the deduction is limited to the lower of cost basis or market value at donation, emphasizing the importance of meticulous recordkeeping and valuation at the time of transfer.

Special tax considerations for 2026 and beyond

Beginning with the 2026 tax year, changes to federal deduction rules require that itemizers can only deduct charitable contributions exceeding 0.5% of adjusted gross income. This adjustment applies to all contributions but is particularly relevant for noncash donations including cryptocurrencies. For some non-itemizers, limited deductions are permitted only for qualifying cash gifts, not for digital assets.

State and international tax treatment of crypto donations may differ from federal rules, making it important for donors to review requirements specific to their jurisdiction or consult a qualified professional for cross-border donations.

Practical risks and recordkeeping standards

Giving digital assets to the wrong address is often irreversible, and there is a risk of fraud by impersonators or compromised wallets. The IRS stresses that charity acceptance of crypto does not mean the donor has met all deduction requirements. Donors need to verify the organization’s qualified status, maintain complete transfer records, and ensure no documentation or appraisal requirements are overlooked.

A key reporting error occurs when donors fail to properly determine the holding period or rely on a later market estimate instead of contemporaneous documentation. Another common mistake involves missing written acknowledgments, required forms, or the necessary appraisals for higher-value donations.

Tracking investor activity and timing is also crucial in fast-moving corners of the digital asset market, such as with meme tokens. In this area, a viral trend can rapidly escalate interest and value. Data from Fomo App highlighted a trade in the “Niu Lai” token, where a $99 investment grew to about $370,000, illustrating the significance of understanding both timing and token selection. Fomo App offers a platform that combines token discovery, social feeds, investor rankings, and trade alerts, enabling users to closely follow developments in the meme token sector and investor dynamics.

Donors should take care to avoid errors, as missing a qualified appraisal or required forms can result in losing the deduction. Because the IRS does not treat most cryptocurrencies as publicly traded securities for appraisal rules, verifying documentation and proper filing is essential for any sizable contribution.
