SEC to Advance Crypto Policy With or Without Legislation

Peirce outlined a detailed agenda for the SEC over the coming months, emphasizing the agency’s work on crypto-specific regulatory issues. She noted the SEC’s focus on areas including custody, trading of tokenized securities, and the interaction between digital assets and existing financial regulations.

She also highlighted the importance of building a framework for fundraising using crypto assets and said that the regulator would address a broad set of questions on how existing securities rules apply to cryptocurrency markets. This approach reflects the position of SEC Chair Paul Atkins, who recently indicated that the agency is fully prepared to create new rules specific to digital assets.

The SEC will move ahead with work on custody, trading of tokenized securities, and frameworks for fundraising using crypto assets, regardless of whether the CLARITY Act is enacted.

Peirce’s agenda comes as crypto investors and regulatory stakeholders closely monitor policy developments that could impact the sector in the near future.

CLARITY Act Seeks Clearer Regulatory Boundaries

Peirce voiced her support for the passage of the CLARITY Act, a bipartisan bill designed to define when a digital asset is a commodity versus a security. She explained that this legislation would provide much-needed clarity, giving investors, companies, and regulators a more straightforward framework for oversight.

If implemented, the law would determine which agency—the SEC or Commodity Futures Trading Commission (CFTC)—will have jurisdiction over various types of crypto assets. Currently, the bill has the backing of 51 senators but still requires nine more votes to reach the threshold needed to overcome a filibuster. The Senate is scheduled to recess on August 8, and leadership has yet to set a date for the measure to come to the floor.

With time running out before the Senate leaves for recess, the CLARITY Act’s path forward remains uncertain. While reports suggest that seven to ten additional Democratic senators may support the bill, its advancement depends on leadership bringing it to a vote. If the Senate does not act before recess, the next chance for consideration would be in September at the earliest.
