Clarity Act unlikely to meet August 7 deadline as Senate faces partisan gridlock

Senate Majority Leader John Thune has acknowledged that the Digital Asset Market Clarity Act, a key piece of cryptocurrency regulation, is facing significant obstacles in meeting its August 7 deadline. This timeframe had been viewed by many in the digital asset industry as essential to advancing the bill in 2026.

Floor debate risks missing deadline

Despite the uncertain prospects, Thune expressed hope that the Clarity Act could at least begin its journey through the Senate prior to the summer recess. Addressing journalists this week, he voiced a desire to bring the legislation to the floor even if senators have not reached a formal bipartisan agreement. Such a move could preserve the small chance of progress when lawmakers return in September.

However, the chamber is working against a tight schedule, and time is running short for any action this summer. Senate leadership has scheduled only a brief session in August, after which campaign activities for the midterm elections will further limit lawmakers’ availability.

Ethics disagreement divides parties

The most significant roadblock to advancing the Clarity Act involves controversial ethics provisions. The bill seeks to prohibit all federal government officials, including President Donald Trump, from developing or endorsing any digital currency. Arizona Senator Ruben Gallego criticized the Republican-sponsored ethics language, calling it inadequate after protracted negotiations.

Meanwhile, Ohio Republican Senator Bernie Moreno defended the current provisions and described them as the strongest ethics standards ever proposed in Congress. The impasse has left senators on both sides considering alternative approaches to bridge the divide.

Gallego signaled he would work with North Carolina Senator Thom Tillis to develop a revised ethics section that could win broader support.

Gallego, underscoring ongoing bipartisan talks, declared his commitment to pushing for workable ethics language as senators search for consensus.

Prospects for passage grow dimmer

The Senate is expected to devote much of its remaining pre-recess session to bipartisan sanctions legislation targeting Russian officials. This measure, championed by the late South Carolina Senator Lindsey Graham, is scheduled for imminent floor consideration, further narrowing the window for the Clarity Act to advance.

White House advisor Patrick Witt, who leads work on digital currency policy, commented that there may still be an opportunity for progress if a debate can start during the first week of August while the chamber is in session. Yet, he acknowledged that the legislative path remains steep.

“I wouldn’t count it out,” said Witt during an interview on CoinDesk TV, maintaining cautious optimism about the act’s prospects before the recess.

If the Senate misses its August window, the likelihood of passing the Clarity Act in 2026 will drop further, as competing priorities and election campaigns dominate the remainder of the year. Any delay would require renewed momentum in the House of Representatives, introducing further procedural hurdles and uncertainty for the digital asset sector.

Wyoming Senator Cynthia Lummis, a key architect of the bill, confirmed that the most contentious aspects remain under negotiation. She indicated that efforts continue to find compromise language that could attract enough Democratic votes for passage before lawmakers leave Washington for the summer.
