New York Attorney General Letitia James has called on Congress to enhance oversight of cryptocurrency companies, cautioning that current legislative proposals could undermine states’ ability to monitor the sector and hold firms accountable for misconduct.
Concerns over federal legislation
In written testimony submitted Monday to the Senate Permanent Subcommittee on Investigations, James expressed concerns about the Digital Asset Market Clarity Act, a federal legislative proposal that would transfer key regulatory powers to the Commodity Futures Trading Commission (CFTC). James argued that this shift could diminish the effectiveness of state and local enforcement efforts.
The Digital Asset Market Clarity Act is designed to create a unified national framework for regulating digital asset markets. However, James warned that overriding state oversight could lead to gaps in consumer protection and weakened accountability for crypto platforms operating in the United States.

Rising consumer complaints and proposed safeguards
James reported that over the past three years, her office has seen a threefold increase in the number of complaints related to crypto scams. Over the last five years, total reported consumer losses have reached nearly $500 million.

She emphasized the need for rigorous requirements on digital asset platforms, including strict anti-money laundering (AML) measures, adherence to know-your-customer (KYC) protocols, and enhanced cybersecurity obligations. James also highlighted the importance of conducting regular surveillance to detect suspicious transactions and potential market manipulation.
James stated that platforms and intermediaries should be held financially responsible when they fail to safeguard customers from fraud or abuse, particularly in light of the sharp increase in scams and consumer losses.
Accountability and transparency measures
James advocated for Congressional action to prohibit platforms from converting crypto tied to mixers or otherwise untraceable sources into US dollars. She also called for the preservation of current state laws governing money transmission, commodities, and securities, arguing that these frameworks are essential for effective consumer protection.
The attorney general further urged Congress to impose restrictions on elected officials and recent government officials, proposing a ban on their involvement in regulating cryptocurrencies if they hold financial interests in the industry. This measure, she said, would help address potential conflicts of interest and ensure greater transparency in the regulatory process.
She urged lawmakers to prioritize robust state and federal collaboration, warning that weakening state powers could benefit bad actors while leaving everyday consumers at increased risk.
