ESMA warns of MiCA scam surge as fraudsters impersonate EU crypto regulators

European financial authorities are alerting the public to a sharp increase in fraudulent schemes that exploit confusion around the Markets in Crypto-Assets regulation (MiCA). Criminals have reportedly impersonated licensed exchanges and even government officials, targeting customers left vulnerable after regulatory changes forced some platforms out of the EU market.

Fraudsters Exploit MiCA Transition, Targeting Customers

Scammers are focusing on clients of crypto companies that failed to secure MiCA authorization before the European Union’s transitional period expired on July 1. Victims have described receiving contacts from individuals posing as regulators, instructing them to shift assets to platforms that appear compliant but are in fact fraudulent.

Stéphane Pontoizeau, executive director at France’s Autorité des Marchés Financiers (AMF), noted that the regulatory shift has provided “an opportunity for scammers more than usual.” The AMF has seen cases where fraudsters masqueraded as its staff and contacted customers of unlicensed exchanges, urging them to use fake websites to transfer their cryptocurrency.

The Dutch Authority for the Financial Markets issued a similar warning. According to the agency, criminals are actively seeking out investors searching for new service providers after their authorized exchange lost access to the EU market.

The European Securities and Markets Authority (ESMA) reported that scammers have also misused its name, branding and logo to lend credibility to their illicit schemes. ESMA stated that it does not contact investors to reclaim lost funds or request administrative fees, and said criminals may fabricate documents, clone legitimate websites, or claim to be investigating crypto platforms.

Scams are particularly effective because genuine exchanges may simultaneously be contacting customers regarding withdrawals, transfers or account restrictions, making it easier for imposters to imitate official communications and instill false urgency.

MiCA’s core regulations have been in force since December 2024, but crypto firms were granted a transitional arrangement allowing them to operate under national frameworks until July 1, 2026, if eligible. This period has now expired, requiring firms to either obtain full authorization or wind down operations within the bloc.

More Than 1,700 Entities Affected, Major Players React

According to ESMA’s interim register, which received its latest update on August 5, more than 320 organizations have achieved authorization under MiCA. Estimates published by the Financial Times indicate that over 1,700 other entities may need to halt or restrict their crypto services in the European Union.

Companies that successfully receive MiCA approval are permitted to offer services throughout the EU. In contrast, unlicensed providers are expected to cease regular business and adopt an organized wind-down process.

Binance, one of the largest global exchanges, missed the deadline and withdrew its MiCA application in Greece. The company is still negotiating with several EU regulators. Binance co-CEO Richard Teng stated in July that the company remains determined to secure a license enabling it to operate legally across the region.

Customers are urged to verify the specific legal entity obtaining authorization, not just a broader group brand, since MiCA’s investor protections apply only when users are served by a regulated European operation.

Investors are advised to avoid making transfers or sharing sensitive information through links received in unsolicited emails, phone calls, or social media messages, as neither regulators nor legitimate exchanges will request passwords, private keys, or recovery phrases.

The overlapping communications from both real and fraudulent actors have intensified confusion, further enabling scammers to convince victims to act quickly and move funds to fake platforms.
