White House adviser accuses Democrats of blocking CLARITY Act vote before recess

White House crypto adviser Patrick Witt publicly accused Senate Democrats of obstructing progress on the CLARITY Act just ahead of legislators’ August recess. Witt, posting on X, identified Senate Majority Leader Chuck Schumer and his allies as orchestrating a full blockade against even a minor procedural vote required to advance the bill on digital asset regulation.

Senate procedural moves and political friction

After an extended overnight vote, the CLARITY Act failed to secure its scheduled pre-summer vote, leaving its path forward uncertain. Republican Senator John Thune responded on Saturday by filing a motion to trigger a key procedural vote on the CLARITY Act immediately after the August break. With the legislative window narrowing, this motion was aimed at preserving the bill’s chance for passage in 2026.

In his official filing, Thune called for an end to debate and a move to proceed on House Resolution 3633. The bill lays out a framework for regulating the offer and sale of digital commodities, splitting oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

Witt pointed to Congress’s multi-year effort to craft a comprehensive framework for digital assets, noting that the Senate’s negotiations on the CLARITY Act had intensified since last summer. He warned that unless the bill reaches a Senate vote by mid-September, its prospects may be lost for good.

If the Senate cannot vote on the bill in September, efforts over the past several years could be rendered moot and the chances for significant digital asset regulation would likely slip away.

September session seen as pivotal for the bill’s progress

Recent analysis from Galaxy Research reflected declining optimism, with the bill’s chances of passing in 2026 lowered from 50% to 30% due to delays approaching the August adjournment. Thune also has previously cited Democratic resistance as a cause for the legislative gridlock, although he remains committed to prioritizing the bill once Congress returns.

The Senate’s September calendar is tight, making the planned floor vote especially consequential. If lawmakers fail to reach agreement, digital asset companies may face prolonged uncertainty over the regulatory landscape, particularly as the November midterm elections draw closer.

Republicans will need to rally their caucus while swaying at least seven Democratic or independent senators to meet the approximate 60-vote threshold required for passage. In the meantime, legislative advocates are working to ensure the bill retains enough momentum for prompt consideration after the recess.

Sticking points remain as lobbying efforts intensify

Several contentious issues remain unresolved, including the approach to financial crime, stablecoin incentive programs, and new ethical guidelines for government officials. Senators Ruben Gallego and Thom Tillis proposed an ethics provision in July aimed at restricting public officials—and their spouses—from introducing or supporting digital assets, a rule to be enforced by state attorneys general. The proposal also requests that President Trump divest from crypto-associated businesses, though he has not yet accepted the plan.

Crypto Council for Innovation CEO Ji Hun Kim stated that the organization will actively lobby both parties over the August break, aiming to secure the votes required for a successful floor decision in September.

The CLARITY Act must compete with other high-priority bills for attention in September, the Senate’s final working period before the midterm elections. Thune’s procedural move allows an immediate vote when the Senate reconvenes on September 14, with the full voting process potentially completed within just a few days.
