FCA opens crypto authorisation gateway, UK firms must apply by February 2027

Crypto businesses operating in the United Kingdom will soon gain access to the Financial Conduct Authority’s (FCA) authorisation gateway, with the opening date set for September 30. The move is intended to enable firms to apply for authorisation before the UK implements its new regulatory regime for cryptoassets.

Key guidance and new authorisation requirements

On September 16, the FCA published its final perimeter guidance, clarifying which cryptoasset activities will require authorisation to operate within the country. This upcoming regime will come into force on October 25, 2027, giving businesses time to prepare for expanded regulatory compliance.

The new framework identifies a range of crypto activities that will now be governed by FCA oversight. These include the issuance of qualifying stablecoins, operation of cryptoasset trading platforms, arranging or dealing in digital asset transactions, safeguarding cryptoassets, and arranging cryptoasset staking services.

The FCA specified that authorisation applications will be accepted from September 30, 2026, until February 28, 2027. Firms planning to benefit from transitional or saving provisions must submit applications within this window. The regulator encourages companies to act quickly rather than wait until the deadline.

To further support the process, the FCA is offering pre-application guidance for firms as they prepare and submit their documentation.

Firms “should start preparing now and not wait until the last minute” to initiate their application process, according to the FCA.

One notable aspect of the framework is that existing registrations under the Money Laundering Regulations (MLRs) do not equate to FCA authorisation under the new rules. Companies already registered for MLRs will still be required to seek Financial Services and Markets Act (FSMA) authorisation if they intend to undertake regulated cryptoasset activities.

This means that digital asset companies must carefully review the nature of their operations to ensure they are ready for these updated requirements before the regime takes effect.

During the transitional period, eligible firms will be allowed to operate under saving and temporary provisions while their applications are being considered, provided they comply with the relevant conditions. Those who fail to apply within the designated timeframe will not be able to access these provisions.

Preparing for compliance and further FCA action

The FCA advises firms to address topics such as market conduct, customer treatment, leadership and governance, and operational systems when preparing for compliance. The regulator has emphasized the importance of understanding how the new regime affects each business model.

“Getting ready for regulation starts with understanding how the regime applies to your business,” the FCA noted in its latest guidance.

This perimeter guidance is an incremental change within the UK’s broader digital asset regulatory environment. Nevertheless, FCA officials have stressed that more detailed work remains. In October, the FCA plans to open a new consultation about adjustments to rules for qualifying stablecoins, proprietary trading, certain technology providers, decentralised protocols, arrangements involving central securities depositaries, and financial promotions.

Cryptoasset firms must prioritize submitting their full applications before the February 28, 2027 deadline or face exclusion from transitional benefits. The enforcement of the wider FCA regime from October 25, 2027 will represent a significant change for the UK’s cryptocurrency sector.
