U.S. cryptocurrency regulatory policy took center stage at the Strobe Summit, where Digital Sovereignty Alliance Managing Director Adrian Wall and former Commodity Futures Trading Commission (CFTC) Chair Chris Giancarlo discussed how agency authority and pending legislation are shaping the future of digital assets.

CFTC’s current powers and regulatory gaps

Wall moderated a discussion at the summit titled “Crypto at a Crossroads: Regulation, Institutional Adoption, and the Future of Financial Markets,” focusing on United States digital-asset rules and the increasing involvement of institutional players. Giancarlo emphasized that the CFTC should set clear regulations using its present authority but also called for Congress to address unresolved regulatory gaps in crypto oversight.

Wall stated regulations should accurately reflect how digital asset markets function in practice. Both speakers highlighted the necessity for regulatory clarity, suggesting that a balanced approach between agency action and congressional legislation could determine whether more crypto activity migrates onshore, influences institutional participation, and strengthens protections for market participants.

The conversation addressed event contracts, moving offshore derivatives into the U.S. regulatory perimeter, and the possibilities that 24/7 trading opens for the market. Additionally, they examined the challenges posed by perpetual futures and decentralized finance (DeFi), including how to ensure accountability on platforms that operate without traditional intermediaries.

Giancarlo argued for exchange rules built on existing CFTC powers, combined with congressional measures to fill regulatory blind spots, while Wall indicated that digital-asset rules must adapt to the unique dynamics of crypto markets.

Key concerns of the conversation included market integrity, cybersecurity, and safeguarding customer assets. The points raised reflected topics for further consideration rather than immediate policy shifts.

Stablecoins, privacy, and legislative updates

Wall and Giancarlo also debated policy developments tied to stablecoins, referencing the recently enacted GENIUS Act. Giancarlo underscored that fiat-backed stablecoins could soon enable 24/7 global dollar transfers, raising new questions about on-chain payment infrastructure and financial privacy. He voiced concerns about ensuring privacy protections in a digital environment where large-scale payments can occur around the clock.

The Office of the Comptroller of the Currency (OCC) confirmed that the GENIUS Act (Public Law 119-27) is in force as of July 18, 2025, and that steps are underway to establish clear frameworks governing payment stablecoin issuers.

Giancarlo’s experience leading the CFTC from 2017 to 2019 included launching the first regulated bitcoin futures and founding LabCFTC. This background framed his focus on policy, innovation, and privacy at the summit.

Legislative gridlock and DeFi accountability

Despite wide-ranging discussion, the summit concluded without new regulations or a legislative agreement. The broader policy context includes the Senate’s September 15 vote on the CLARITY Act (H.R. 3633), which failed to reach the 60-vote threshold needed to advance, with 49 votes in support and 50 opposed. The result leaves the bill’s long-term prospects uncertain.

Senator Cynthia Lummis noted the revised CLARITY Act introduced provisions requiring some non-decentralized DeFi protocols to register with the CFTC and comply with anti-money-laundering rules. She stated that more than 114 amendments were included at the request of Democratic senators, reflecting ongoing negotiation and uncertainty in digital asset policy.

The summit account highlighted the need for clear accountability frameworks for decentralized finance, especially for platforms lacking traditional intermediaries, but did not set out a timeline for implementation.

Market reaction and sentiment

The summit did not trigger any direct market moves. As of November 6, CoinGecko data showed key digital assets lower over the prior 24 hours: bitcoin at $76,012 down 5.42%, ethereum at $2,239.56 down 7.26%, and XRP at $1.20 down 9.26%. These numbers are market snapshots and not directly linked to the summit’s discussions.

On the same day, Alternative.me’s Crypto Fear & Greed Index showed a reading of 28, categorized as “Fear.” Analyst commentary published by Investing.com, citing Reuters, tied bitcoin’s decline after the September CLARITY Act vote to market disappointment, with Coinbase CEO Brian Armstrong calling the result “disappointing” and pressing for regulatory clarity under current agency authority. These remarks were related to legislative setbacks, not recent summit events.

There is no direct evidence suggesting that recent price movements were caused by regulatory debates or summit developments. Market data and sentiment indices represent conditions at a specific time and should not be interpreted as demonstrating causality.

In a climate of regulatory uncertainty, investors may find it challenging to keep track of significant policy changes that impact the market. Investor takeaways

The summit’s focus remained on policy questions and future market structure rather than providing a digital asset outlook or guarantees. Wall and Giancarlo discussed stronger regulatory frameworks for issues like market integrity, cybersecurity, customer protection, and accountability in DeFi without setting out specific regulatory actions or timelines.

The GENIUS Act’s implementation by the OCC is one concrete legislative development underway, representing an incremental step within broader ongoing debates about industry oversight. Market participants continue to watch for signs of further regulatory clarity and potential legislative breakthroughs.
