US Senator Elizabeth Warren, known for her strong criticism of cryptocurrency, has called for Congressional action on digital asset regulation. In a recently circulated video, Warren emphasized the need for crypto-specific legislation. “We need crypto legislation. I’ve been saying this for a long time,” she stated, signaling possible willingness to back targeted legal frameworks for the sector.

Senate blocks CLARITY Act in close vote

On September 15, the Senate narrowly rejected a procedural step to advance the CLARITY Act, with a 49-50 vote. None of the chamber’s Democrats supported the measure, and four Republicans—Collins, Hawley, Moran, and Tillis—also voted against it. The proposal needed 60 votes to move forward.

The CLARITY Act had been under negotiation for over a year, with Republican lawmakers incorporating 126 substantive changes at Democrats’ request. President Trump agreed to major ethics provisions covering key government officials, including Congress and the judiciary. Despite these concessions, talks broke down on the morning of the vote when Democrats submitted a final counter-offer, which Republicans declined.

Democratic senators did not back the bill, but several now say they support the goal of clearer regulation for crypto, raising the possibility of renewed negotiations.

Democrats reconsider talks after initial rejection

Following the failed vote, seven Senate Democrats expressed interest in reopening negotiations on the bill. These senators are now publicly voicing support for the principle of crypto legislation, even as they call for further dialogue. This marks a notable shift from their earlier position, when they blocked the measure while pushing for additional changes.

Elizabeth Warren’s recent remarks reflect this emerging stance within the Democratic Party, which appears increasingly open to addressing cryptocurrency regulation in Congress.

Procedural strategies keep the bill viable

Senator Thom Tillis, one of the Republicans who voted against the measure, did so strategically to preserve the opportunity to revisit the bill. Under Senate rules, a senator who votes with the prevailing side can move for reconsideration. Tillis exercised this option within a minute of the vote’s conclusion, leaving the door open for a second cloture vote without needing a new motion to proceed.

This move ensures that the CLARITY Act technically remains alive and could return to the agenda, depending on further developments in negotiations.
