Regulatory framework and implementation timeline

The OCC released its final rule earlier this week, with the regulation scheduled to take effect on January 18, 2027. The framework follows the enactment of the GENIUS Act in July 2025, which established federal requirements for eligible payment stablecoin issuers and outlined prohibitions for digital asset service providers selling non-compliant stablecoins to US consumers.

These new federal standards apply to subsidiaries of national banks and federal savings associations, non-bank entities authorized by the federal government, state-approved issuers, and eligible foreign issuers. In addition, the rules oversee custody activities conducted by OCC-regulated entities.

The regulatory structure covers crucial operational areas such as reserve asset composition, redemption obligations, audit procedures, mandatory reporting, and secure custody arrangements. OCC officials emphasize that these standards are designed to foster innovation while maintaining strong safeguards for consumers and the financial system.

Scope, eligibility, and application process

The framework provides detailed guidance for how state-qualified issuers can become subject to federal supervision. It also specifies scenarios in which the OCC may revoke an issuer’s approval, ensuring ongoing compliance with regulatory obligations.

Jonathan Gould, Comptroller of the Currency, said the rules establish ground rules for stablecoin innovation and aim to secure adequate reserve backing, streamlined redemption, and robust risk controls for the sector.

By introducing clear expectations for reserve support, redemption, and risk management, the OCC is seeking to “enable innovation in stablecoin payments while upholding confidence in the broader financial system,” commented Comptroller Gould.

The final framework was developed after an extensive public consultation, with feedback collected from crypto firms, community banks, trade groups, academics, and other stakeholders. The regulator originally proposed the framework in February 2026, with a 60-day window for comments.

Applicants already issuing stablecoins may seek waivers if their applications are nearly complete, helping them avoid operational disruptions during the regulatory transition. The OCC will provide additional notification before accepting formal applications, allowing entities time to gather documentation and assess compliance.

GENIUS Act and stablecoin oversight

The GENIUS Act restricts payment stablecoin issuance in the US to eligible issuers and qualified foreign entities. The legislation also blocks digital asset providers from distributing payment stablecoins to Americans unless the stablecoins originate from approved issuers.

This law has created a national framework for managing payment stablecoins, with particular emphasis on reserve guarantees and transparent redemption rights, all designed to protect token holders.

Treasury Secretary Scott Bessent drew parallels between the GENIUS Act and the 1863 National Currency Act, highlighting both as pivotal in shaping future financial infrastructure in their respective eras.

The OCC’s regulations now provide the tools to implement key provisions of the GENIUS Act, making compliance analysis essential for covered entities ahead of the 2027 enforcement date.

Exclusions and ongoing oversight

The OCC Stablecoin Rules do not address anti-money laundering or sanctions compliance. These matters fall under separate Treasury Department rulemaking, specifically under FinCEN and the Office of Foreign Assets Control (OFAC).

Issuers now have until January 18, 2027, to develop or update reserve arrangements, redemption processes, risk management programs, custody solutions, and mandatory reporting systems in line with these federal standards.

Overall, the regulations represent a significant federal initiative, offering clarity for payment stablecoin issuers and laying out the preparation steps for their transition to the new regime.
