Senator Josh Hawley has sparked controversy in the cryptocurrency community after the U.S. Senate voted against the CLARITY Act, a bill that aimed to establish a regulatory framework for digital assets. The legislation fell short of the 60 votes needed, securing just 49 votes. This outcome disappointed advocates of clearer crypto regulation, including many in the XRP community.

Senator Hawley voices opposition concerns

Hawley, a Republican representing Missouri, was among four party members to vote against the bill. He attributed his decision to concerns from the state’s agricultural community, stating that local farmers worried they could lose access to loans from small-town banks if the bill passed. According to Hawley, there was a fear that investors would withdraw funds from these banks seeking higher yields enabled by the legislation, potentially putting rural lending at risk.

Hawley further explained that the provision could drain capital from community banks critical to rural economies. He referenced Senator Jerry Moran’s proposed amendments aimed at addressing these banking concerns and indicated willingness to consider fixes to ensure small banks remain operational and competitive in lending practices.

Schwartz challenges senator’s motives

David Schwartz, Ripple’s CTO Emeritus and a key architect of the XRP Ledger, quickly replied to Hawley’s public comments on X. Schwartz’s remarks suggested that the senator’s objection reflected a desire to protect bank profits over encouraging innovation in the financial sector.

Schwartz described the senator’s statement as “saying the quiet part out loud,” asserting that the real issue was safeguarding established banking interests.

Ripple is a fintech company focused on developing payment and settlement solutions using blockchain technology and is closely associated with XRP, a leading cryptocurrency used for cross-border transactions.

Several major banking associations reportedly joined forces to lobby against the CLARITY Act, reinforcing Schwartz’s view that institutional resistance influenced the Senate’s decision more than the stated concerns for rural lending.

Arguments over impact on loans and farmers

Schwartz dismissed Hawley’s argument that passing the bill would jeopardize loan access for farmers. He wrote on X that the act would not significantly reduce the ability of banks to issue loans. Even if it did, Schwartz argued, new alternative sources of capital would emerge to fill any gaps left by banks, supporting rural borrowers and agricultural businesses.

Schwartz maintained that, “A thriving ecosystem of investors seeking reasonable yields would emerge to provide those same loans, replacing any lost bank capacity.”

He challenged the premise that traditional banking structures are essential for supporting agricultural lending, suggesting the bill could enable more diverse financial options without harming rural communities.

Implications for XRP and crypto regulation

The rejection of the CLARITY Act leaves XRP and the broader crypto sector without a comprehensive federal regulatory framework. The Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) are expected to continue overseeing the sector through guidance and enforcement actions rather than through legislation.

Paul Atkins, Chair of the SEC, has previously emphasized that regulatory guidance alone is insufficient without statutory backing. With the bill’s defeat, the crypto industry remains reliant on evolving agency interpretation.

Many XRP holders and blockchain advocates argue the Senate vote protects institutional power at the cost of industry growth and regulatory certainty.
