Federal prosecutors have charged two engineers at Robinhood, a California-based financial technology company known for its commission-free trading platform, with commodities fraud and wire fraud related to alleged insider trading involving cryptocurrency futures.

Alleged misuse of confidential information

Prosecutors allege that Hefu Chai, 36, and Huaisong “Jerry” Xiang, 30, used confidential information about upcoming digital asset listings on Robinhood Crypto to execute profitable trades on the decentralized exchange Hyperliquid.

Authorities claim the defendants exploited their access within Robinhood, purchasing perpetual futures contracts tied to tokens set to be listed, ahead of public announcements. This activity reportedly took place between 2025 and 2026.

Each engineer is accused of earning more than $50,000 by trading derivatives using nonpublic details about token listings. Federal officials outlined that the profits were generated “for their own benefit.”

Today’s charges, according to U.S. Attorney Jamie McDonald, demonstrate that corporate insiders cannot avoid securities and commodities laws by using misappropriated information to trade in derivatives such as perpetual futures, tokenized securities, or similar financial instruments.

Enforcement approach and ongoing scrutiny

The Department of Justice stated that Chai and Xiang face one count of commodities fraud and one count of wire fraud. If convicted, commodities fraud carries a maximum sentence of 10 years in prison, while wire fraud can result in up to 20 years.

Rather than pursuing securities fraud charges, prosecutors are applying the Commodity Exchange Act to address alleged insider trading through derivatives.

Robinhood has supported the investigation, according to federal authorities.

The charges come as decentralized finance platforms like Hyperliquid, which ranks among the largest exchanges for perpetual futures trading, have drawn increased attention from regulators.

Mini dictionary: Perpetual futures (“perps”) are derivatives that let traders speculate on the price of an asset without owning it, and unlike traditional futures, they do not have an expiration date. These instruments are widely used on decentralized platforms and often allow leveraged trading.

This case follows a notable enforcement action involving former Coinbase product manager Ishan Wahi, who was charged in a similar case for passing on confidential token-listing information. Wahi ultimately pleaded guilty to wire fraud conspiracy.

The Justice Department’s focus on insider trading involving digital assets and derivatives highlights ongoing regulatory interest in crypto market integrity, especially as companies like Robinhood expand their presence in cryptocurrency futures.
