Senator Cynthia Lummis continues to push for progress on the CLARITY Act, a comprehensive digital asset regulation bill, expressing growing frustration at the lack of movement in the U.S. Senate. Lummis, who has represented Wyoming since 2020, has focused her tenure on solidifying regulatory frameworks for digital assets to ensure companies remain both in her state and across the country.

Major hurdles for digital asset regulation

Cynthia Lummis and Senator Kirsten Gillibrand introduced the initial version of the Responsible Financial Innovation Act in June 2022, aiming to distribute regulatory responsibility between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). The bill also introduced provisions for stablecoins and totaled 168 pages at introduction. Instead of establishing a new government agency, the bill adapted existing frameworks to cover digital assets.

By 2023, lawmakers expanded the bill to 274 pages, addressing issues such as crypto mixers, tumblers, ATM regulation, simplified customer agreements, and stricter oversight of crypto advertising. The legislative package eventually evolved into the CLARITY Act, reaching 616 pages and aiming to encourage industry growth on American soil, safeguard consumers, and limit illicit finance.

Senator Cynthia Lummis positioned the act as a way to “grow on American terms,” arguing that clear rules can protect U.S. leadership and security in the global digital asset market.

Intense partisan debate

After nearly a year of negotiations, Lummis has signaled exasperation with continued opposition from Democratic senators. She emphasized the bill’s extensive compromises and called for action:

After nearly 11 months of giving almost everything asked of us, I genuinely don’t know what else my Democrat colleagues need before we act.

The CLARITY Act advanced out of the Senate Banking Committee in May with bipartisan backing, earning a 15-9 vote. In order to pass on the Senate floor, the measure requires at least 60 votes, including support from at least nine Democrats. Although some Democratic senators have indicated a willingness to back the act, those votes have yet to appear.

Democrats push ethics and consumer protection

In the lead-up to the committee vote, Senator Elizabeth Warren filed over 40 amendments, reflecting broader Democratic reservations. In total, committee members submitted more than 100 amendments, and American Bankers Association members sent over 8,000 letters urging caution on the legislation. One key Warren proposal would prohibit the Federal Reserve from granting master accounts to companies operating in the crypto sector.

Democratic committee members have unanimously supported an amendment to give the Treasury Department authority to sanction decentralized finance (DeFi) providers, an effort Republicans entirely opposed.

Mini dictionary: DeFi (Decentralized Finance) refers to blockchain-based financial services that do not rely on traditional centralized intermediaries, allowing users to interact directly in lending, borrowing, and trading activities.

Warren and her allies have also demanded robust ethics requirements to address concerns from recent controversies over officials’ potential financial interests in cryptocurrencies. In response, Republican senators released an updated ethics section in late July targeting those concerns, with particular focus on matters related to Trump’s meme coins and the company World Liberty Financial. Despite these efforts, support from many Democrats remains uncertain.

Senate vote deadline approaches

Senate Majority Leader John Thune has committed to bringing the CLARITY Act to a floor vote before the August 8 recess. Should lawmakers fail to pass the act, the U.S. will continue operating without clear federal rules for digital assets, leaving gaps in consumer protection and official conduct standards. With the congressional window for action closing, both industry participants and consumer advocates are watching developments closely.

The window for responsible digital asset regulation is narrowing, and the absence of federal clarity leaves both consumers and industry at risk.
