On October 16, 2026, the Commodity Futures Trading Commission (CFTC) formally requested that a federal judge dismiss CME Group’s lawsuit regarding the competition for US crypto perpetual futures contracts. The CFTC asserted that CME Group had failed to demonstrate how the approval of similar products by competing exchanges would materially harm its business interests.

Key arguments in the legal dispute

In documents filed with the federal court presided over by Judge Colleen Kollar-Kotelly, the CFTC maintained that CME needs to establish a real or imminent increase in competition to justify its case, something the regulator claims CME has not accomplished. CME Group is one of the world’s largest derivatives marketplaces, active in trading futures and options across a broad array of asset classes.

“CME must plausibly allege an actual or imminent increase in competition. CME has not even done that,” the CFTC wrote in its court filing.

The CFTC highlighted a statement from CME Group Chairman Terence Duffy delivered on July 22, 2026. Duffy indicated that, according to their clients, perpetual contracts offered little demand and did not provide a viable hedging option for firms.

“CME cannot have it one way with the court and another way with the investing public on earnings calls,” the commission argued.

CME’s lawsuit and basis for challenge

CME initiated its lawsuit on June 18, 2026, after the CFTC approved KalshiEX’s Bitcoin perpetual contract (BTCPERP) on May 29, 2026, with approval granted shortly after submission. At the time, Michael Selig was the only confirmed CFTC commissioner.

Unlike standard futures, perpetual contracts do not have expiration dates. CME maintains this makes them swaps, not futures, under the Dodd-Frank and Commodity Exchange Acts. This differentiation has regulatory implications for margin requirements, registration obligations, and tax treatment. In addition, CME questioned why the CFTC approved the contract without a public comment period and then permitted other platforms to introduce similar contracts via self-certification.

Michael Selig dismissed CME’s objections, labeling them as standard pushback from an incumbent market player.

Mini dictionary: Perpetual contracts are derivatives similar to futures but without an expiry or settlement date, allowing traders to hold positions indefinitely as long as margin requirements are met. They typically rely on a funding rate mechanism to keep prices in line with spot markets.

Classification debate and market implications

If the court rules only on standing and chooses to dismiss the case, the broader question concerning whether these contracts are swaps or futures will remain unsettled. This would leave the CFTC able to continue its case-by-case approach to product classification without a definitive judicial ruling.

TD Cowen analyst Jaret Seiberg expressed concern about the rising volume of perpetual contracts across crypto markets while this litigation continues.

Seiberg noted that the expansion of perpetuals could create significant challenges if CME ultimately prevails and disruptions are required.

If courts side with CME, the US perpetual futures market could face significant changes. Conversely, a ruling that upholds the CFTC’s actions could solidify the regulator’s current classification approach for such contracts.

Trading volumes highlight stakes in dispute

CME Group reported an average daily cryptocurrency trading volume of 174,000 contracts in September 2026, valued at $8.6 billion. This robust activity supports the CFTC’s view that the market is both active and significant.

By comparison, a 2026 report from CryptoQuant estimates that Binance’s perpetual contracts reached approximately $25 trillion in trading volume in 2025, marking a 20% increase. For many major exchanges, perpetuals account for 70% to 90% of overall crypto trading activity.

Analysts caution that while these numbers illustrate the market’s scale, they do not address the adequacy of current risk oversight. In an April 2026 paper, Denise Garcia Ocampo, Peter Goodrich, and Gian-Piero Lovicu from the Bank for International Settlements warned that many crypto intermediaries do not publish financial statements, making regulatory supervision challenging as these firms expand into lending and derivatives.

For this reason, the dispute extends beyond the interests of CME’s business. If the lawsuit is dismissed, the expansion of perpetual futures could continue under the CFTC’s current framework, even though questions remain about proper classification and risk management in such a fast-growing market.
