The Commodity Futures Trading Commission (CFTC) has revised its frequently asked questions (FAQs) on cryptocurrencies and blockchain technology, clarifying how current regulations apply to tokenized investments and blockchain-based recordkeeping. This update, published on September 24, 2026, focuses on the requirements for regulated entities rather than endorsing digital assets more broadly.

The CFTC targeted two key areas in its latest FAQ: the use of tokenized versions of otherwise permitted investments for handling customer funds, and the implementation of blockchain technology for required recordkeeping. This update represents a coordinated effort between the agency’s Market Participants, Market Oversight, and Clearing and Risk divisions.

The revised FAQs, initially released on March 20, 2026, also refer to the CFTC’s prior official positions concerning tokenized collateral and the use of digital assets as margin. The new document reflects the Commission’s ongoing efforts to address recent technological developments within the regulatory framework for derivatives markets.

The CFTC emphasizes that updating its FAQ does not serve as a blanket endorsement for every tokenized product or blockchain service. Instead, regulated parties must examine how the updated guidelines apply to their own operations.

Difference between tokenization and regulatory eligibility

A central clarification is that representing an asset on a digital ledger does not automatically qualify it for regulatory use. Operators must continue to apply existing eligibility tests and confirm the rights attached to any instrument, regardless of whether it is tokenized. The mechanics of a blockchain record do not negate the underlying legal requirements for managing customer assets.

Similarly, simply using a distributed ledger for recordkeeping does not exempt an operator from practical regulatory requirements. Accessibility, the ability to retrieve records, and compliance with retention obligations must still be demonstrated by firms.
