Michael Saylor, executive chairman of MicroStrategy and a prominent Bitcoin advocate, commented that US citizens are not required to obtain a license to talk about Bitcoin, encourage its use, or publicly recommend holding it. He asserted that because Bitcoin is defined as a commodity, engaging in open discussion or advocacy should remain protected, while fraudulent activities and market manipulation are still prohibited.

Saylor emphasized the distinction between speaking about Bitcoin and conducting activities that fall within the realm of regulated financial services. He maintained that freely expressing views about Bitcoin ownership should not be subject to regulatory permissions or oversight. This position reflects the evolving regulatory landscape in the US, which has increasingly recognized Bitcoin’s status as a commodity rather than a security.

According to Saylor, “No license is required to discuss Bitcoin or advocate for its adoption in the United States, provided those actions do not cross into fraud or market abuse.”

Freely expressing support for Bitcoin or recommending its ownership remains protected speech in the US, so long as it does not involve fraudulent practices or efforts to manipulate the market.

In March 2026, a joint interpretation from the US Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) expressly listed Bitcoin among “digital commodities.” This built on the CFTC’s long-standing position that Bitcoin is a commodity. Bitcoin futures and derivatives fall within CFTC oversight, while the underlying spot market for Bitcoin is treated differently, meaning CFTC intervention is limited to fraud or manipulation cases.

This distinction has provided greater clarity. In previous years, different US regulators sometimes disagreed about how to define and govern cryptoassets. Saylor’s remarks underscore the recent regulatory alignment rather than citing a new development for Bitcoin.

Regulatory approaches differ globally

While the US has taken a relatively permissive stance on public discussion and advocacy related to Bitcoin, approaches differ worldwide. In the UK, for example, Bitcoin itself is not classified as a security, but laws on financial promotions cover a wide range of cryptoassets, including Bitcoin, when promotional activities target consumers.

From October 2023, organizations promoting crypto to UK consumers have had to comply with strict rules enforced by the Financial Conduct Authority (FCA), which has the power to act against illegal promotions.

In Singapore, the Monetary Authority of Singapore has cautioned crypto firms against advertising their services directly to the public, reflecting concerns about the risks of retail crypto trading. Canadian regulations allow private discussion and ownership of crypto; however, companies offering crypto trading services must be registered and observe securities rules.

These regulatory differences mean that a business based in the US may have more flexibility to advocate for Bitcoin as part of its brand, compared to firms operating in the UK or Singapore, where marketing efforts are more tightly controlled. UK authorities have previously enforced penalties for violations of promotional rules, underlining their willingness to intervene when boundaries are crossed.

Saylor suggested that this regulatory approach could make the US more appealing for businesses focused on Bitcoin education, media, and advocacy. However, as cryptocurrencies become increasingly integrated into mainstream finance, regulators around the world will need to determine how to balance freedom of speech with consumer protection.

Saylor also commented that Bitcoin could experience another price rally in the near future, attributing potential growth to continued institutional and corporate demand absorbing the available supply.
