The CLARITY Act, a major legislative effort aiming to overhaul U.S. cryptocurrency regulation, is encountering renewed opposition in the Senate. Prominent cryptocurrency commentator BankXRP has brought attention to a new report from Senate Democrats warning of five substantial loopholes in the proposed bill.

According to the Democratic report, the main issues include weakened Securities and Exchange Commission (SEC) enforcement authority over the crypto industry, anti-money laundering gaps involving decentralized finance (DeFi) applications and crypto mixers, and the absence of a private right of action for investors harmed by digital asset misconduct.

Democratic leaders argue that these shortcomings could leave investors unprotected and fail to close legal gaps that bad actors exploit within the fast-moving crypto sector.

Senate Democrats stressed that the bill “fails to equip federal watchdogs with the enforcement powers needed for effective oversight,” and pointed to “critical failures to address money laundering risks and ensure investor recourse.”

The report’s release signals that Democratic support for the CLARITY Act remains uncertain ahead of the upcoming Senate cloture vote scheduled for September 15. The measure requires at least 60 votes to advance, a hurdle that relies on significant bipartisan backing.

Trump’s crypto earnings heighten scrutiny

BankXRP emphasized that financial disclosures show Donald Trump, in his first year back in office as U.S. President, earned $1.4 billion from cryptocurrency-related ventures in 2025. This sum constituted nearly two-thirds of his total income for the year and marked the largest wealth increase on record for an American president.

These figures have amplified Democrats’ calls for stricter ethics provisions within the bill. The current draft prohibits the president, vice president, members of Congress, federal judges, and certain federal officials—as well as their spouses—from issuing or sponsoring digital assets while in office. However, critics note that the enforcement is limited to the Department of Justice, excluding state attorneys general, and does not address income from indirect avenues such as World Liberty Financial, memecoin royalties, or licensing deals.

BankXRP stated that “the CLARITY Act will fail unless 7 Democrats vote yes,” highlighting that bipartisan consensus is essential but far from assured.

The path to 60 votes: Search for support

Senator Bernie Moreno, a Republican from Ohio, affirmed that all 53 Senate Republicans are committed to supporting the bill. This leaves at least seven additional votes required from Democratic senators to surpass the filibuster threshold. Reports suggest that between seven and ten Democrats are open to backing the bill, though the recent report may sway undecided members to withhold their support.

Senator Moreno has dismissed suggestions that additional negotiations are needed, maintaining that the legislative text is final and all senators will now proceed to a vote. The Senate returns from recess with the September 15 vote formally scheduled, following Majority Leader John Thune’s move to file cloture before the break.

Democratic report strengthens opposition

Although Republican senators remain unified, the Democrats’ report has given opponents of the bill extra justification to withhold their votes. The focus now shifts to whether enough Democrats will break ranks and join the GOP to approve the legislation.

The outcome is expected to have significant implications for the regulatory landscape of digital assets in the United States and could set a precedent for how financial disclosures and personal earnings intersect with future crypto policy.
