Senate Republicans have released a new 630-page draft of the CLARITY Act, presenting significant implications for the cryptocurrency industry, including Bitcoin, Ethereum, and XRP. The revised version was circulated just days before a crucial procedural vote scheduled for September 15.

Political divide and Democratic skepticism

The updated CLARITY Act remains exclusively a Republican initiative, without the backing of Democratic lawmakers. Despite some Democrats showing interest in regulating digital assets, persistent political disagreement has hampered progress toward a bipartisan bill.

According to journalist Brendan Pedersen, several Democratic aides remain wary of the bill, with one describing an ongoing ethics dispute as “the biggest stumbling block by far.” The aide also remarked that the new version fails to address these ethical concerns.

This latest proposal does nothing to resolve those concerns, according to the Democratic aide, reflecting continuing fears about unresolved ethics disputes.

The impasse is expected to influence the upcoming Senate vote, where lawmakers will decide whether to advance the bill for further consideration. Scheduled for September 15 at 2:15 p.m. ET, this cloture motion would allow debate to move forward but is not a final vote on passing the legislation.

Key updates in the bill’s language

The revised draft marks a clear distinction between genuinely decentralized protocols and what it calls “non-decentralized finance trading protocols.” Under this language, simple participation in decentralized governance or security councils does not automatically equate to control over a network.

At the same time, the bill preserves important protections for software developers, clarifying liability boundaries regarding the creation of code for decentralized finance applications.

Changes to the DeFi section specifically redirect regulatory focus toward digital-commodity cash and spot markets, aiming to clarify the scope of oversight.

The updated bill also introduces stronger provisions concerning credit unions. The National Credit Union Administration and similar entities will maintain their regulatory and enforcement authorities under the proposed legislation.

Technical revisions to the GENIUS Act are included to ensure that credit-union accounts are treated more equitably alongside traditional bank deposits, particularly when managing tokenized financial products.

Unresolved disputes and what’s next

Despite the policy changes in the revised CLARITY Act, the fundamental political divide persists. Key disputes, particularly over ethics concerns, remain unresolved, casting uncertainty over the bill’s path forward.

The upcoming procedural vote will determine whether the Senate can begin debate on the legislation. However, without bipartisan support, Republicans must convince a sufficient number of Democrats to move the discussion forward.

If the cloture motion fails, the legislation will stall, and the future of crypto regulation in the US may remain gridlocked until a more widely accepted proposal emerges.

The bill changes several regulatory mechanics and clarifies DeFi oversight, but the unresolved political dispute will likely decide whether it advances.
