A member of South Korea’s National Assembly has moved to extend the implementation of the country’s virtual asset income tax law by three years, proposing a new enforcement date of January 1, 2030. Jeong Seong-guk from the People Power Party introduced this legislative amendment, which aims to allow regulators more time to review and strengthen oversight mechanisms for cryptocurrency taxation and market protections.

Push to postpone crypto tax enforcement

Jeong advocates for a revision of the Income Tax Act that would officially push back the start date from January 1, 2027, to 2030. He argues this postponement would afford policymakers adequate opportunity to refine the tax regime, weigh broader regulatory implications, and enhance investor protections within the evolving digital asset landscape.

Under the structure set by current law, South Korea would levy taxes on transaction and lending revenues related to cryptocurrencies as miscellaneous income. Profits above 2.5 million won per year would incur a 22% tax, consisting of a 20% national income levy and a 2% local tax. These measures would apply to earnings from digital assets such as Bitcoin and Ethereum.

While Jeong supports continued development of the taxation regime through legislative deliberation, his proposal seeks to delay its full implementation rather than abolish it. This approach contrasts with other legislative actions targeting the complete removal of these tax obligations.

Debate over 2027 start date and government resistance

South Korea’s government reaffirmed the January 2027 timeline as part of its recent tax reform package, declining additional extensions amid calls for legislative adjustments. Finance Minister Koo Yun-cheol has indicated support for maintaining the current schedule, stating authorities could update administrative and regulatory frameworks after collecting practical experience with the system.

This position has drawn opposition from lawmakers seeking further postponement or outright cancellation of the crypto tax. South Korea initially planned to roll out digital asset taxation in January 2022, but subsequent deferrals pushed the date back first to 2023, then 2025, and ultimately to 2027. Legislative authority over the final timeline remains with the National Assembly, and further adjustments remain possible until enforcement begins.

Jeong Seong-guk contends that a longer timeline is necessary for stakeholders to prepare for the complexity and regulatory risks associated with bringing cryptocurrencies within the national tax system. He maintains that “extended preparation periods are critical for regulatory authorities to implement a robust administrative environment.”

Opposition efforts for broader reform

Some opposition lawmakers argue the bifurcated tax approach — imposing levies on digital asset gains while waiving most capital gains for stocks — has created imbalances in the country’s tax policy. In response, legislator Song Eon-seok introduced a bill seeking to strike the cryptocurrency income tax clause entirely from the Income Tax Act. The Finance and Economic Planning Committee in the National Assembly is now reviewing this proposal, but further progress could be hindered by the administration’s continued push for implementation.

Amid this debate, South Korean regulators continue their broader drive for comprehensive digital asset oversight. Ongoing efforts target regulation of stablecoins, trading platforms, transparency standards, and internal corporate governance. Many policymakers have also called for new rules to allow institutional participation in cryptocurrencies through vehicles such as spot exchange-traded funds.
