Aave moves $71 million in ETH after Kelp DAO hack vote

Aave and other stakeholders affected by last month’s Kelp DAO hack have initiated a binding governance vote on Arbitrum, seeking to transfer $71 million worth of disputed ether (ETH) to an address under Aave’s control. This latest step aims to reach an official on-chain decision regarding the movement of assets through the protocol’s governance system.

Crucial Arbitrum vote and recent court ruling

Dubbed the Constitutional Arbitrum Improvement Proposal, the process stands out as a formal governance mechanism within the Arbitrum community for deciding on critical matters. The updated version of this proposal is grounded in a recent court decision by Judge Margaret Garnett, which permits Arbitrum DAO to hold an on-chain vote to move the frozen ETH from its current account to an Aave-controlled wallet. However, pending lawsuits involving alleged links to North Korea and terrorism compensation claims will be taken into account as these assets are transferred.

If the proposal passes, 30,765 ETH currently frozen by the Arbitrum Security Council will be moved to an address governed by Aave, in line with the court’s stipulations. Nonetheless, Aave will not have unrestricted access to the funds nor be able to transfer them freely unless the court issues further authorization. Strict legal restrictions will remain in place on the use of these assets.

Claims of North Korea ties spark legal dispute

The legal battle over the frozen assets escalated after blockchain analysis companies linked the incident to North Korea’s infamous Lazarus Group. Yet these claims have not been officially recognized or legally validated within either Arbitrum’s governance process or ongoing court proceedings, and remain rooted in external forensic and investigative reports.

While technical analyses suggest potential North Korean involvement, this allegation has not yet been legally confirmed.

Despite this, attorneys representing families with more than $877 million in outstanding US terrorism compensation claims have argued that, should legal proof establish North Korean ownership of the funds, these assets could be seized to pay court-awarded compensation. This argument carries significant weight for both affected users and potential claimants.

Disputed ETH divides DeFi users and claimants

Aave maintains that the frozen ETH rightfully belongs to users victimized by the attack, arguing that the hacker’s brief control of the assets did not transfer ownership. As a result, the matter has evolved into a complex debate over how the recovered funds should be distributed between decentralized finance users and parties seeking compensation for acts of terrorism.

As a prominent DeFi lending platform, Aave serves a vast global user base. The high-profile legal fight following the Kelp DAO breach could potentially set crucial precedents for digital asset management and cross-border legal claims in the decentralized finance sector.
