The US Federal Election Commission’s (FEC) electronic filing system has gone offline, following reports of a cyberattack, raising concerns over transparency in political spending ahead of the 2026 midterm elections. The disruption may obscure spending activity by super political action committees (PACs) and other fundraising groups at a critical time when public disclosure is mandatory under campaign finance laws.

Hack disrupts last-minute transparency

As of Tuesday at 7:48 pm UTC, the FEC confirmed that its filing system was experiencing an “electronic filing system outage.” Agency officials stated that staff were working to restore service. Despite the outage, previously filed public records remained accessible, though any new filings, including last-minute expenditures, could go unreported until the system resumes full functionality.

This has immediate implications for transparency. Federal regulations require super PACs to report certain expenditures within 24 hours if they exceed $1,000. Candidates for the House and Senate must also quickly disclose sizable contributions in the final weeks before an election, making continuous system access critical.

The uncertainty coincides with heightened activity from crypto industry-aligned super PACs, which include Fairshake, Defend American Jobs, Protect Progress, Fellowship, and Digital Freedom Fund. According to FEC records available before the outage, these groups reported no new spending since Sunday, six days ahead of Election Day.

Reuters cited an internal email attributing the operational disruption to a targeted hacker attack at the FEC website. An FEC spokesperson said that agency IT teams were “actively working to restore service.”

Details of recent crypto PAC expenditures

Within the week before the filing system went offline, Digital Freedom Fund—a PAC founded by Gemini’s Cameron and Tyler Winklevoss—reported over $572,000 spent on text message campaigns backing various Republican Senate candidates, most significantly to support Ken Paxton’s campaign in Texas. Protect Progress documented its most recent expenses with a more than $50,000 direct mail campaign advocating for Representative Aisha Wahab in California’s 14th district.

Super PACs may play a decisive role in shaping the outcome of the 2026 midterms, particularly for voters concerned with digital asset legislation. After Congress failed to advance the crypto market structure bill in September, industry advocates such as Fairshake pivoted their support toward lawmakers who backed the legislation.

Super PACs face strict disclosure rules, as they must report all qualifying expenditures exceeding $1,000 within 24 hours of payment, while congressional candidates must declare significant donations within 48 hours during the pre-election period.

Ongoing campaign battles in Ohio

In 2024, Fairshake spent approximately $41 million opposing Democratic Senator Sherrod Brown’s reelection campaign against challenger Bernie Moreno. Brown ultimately lost his seat and announced intentions to run against incumbent Jon Husted in 2026. This has set up another contest expected to attract substantial funding from crypto industry supporters and other politically active groups.

Before the FEC system went down, Fairshake disclosed $56 million spent on media opposing Brown and supporting Husted, while the Digital Freedom Fund revealed more than $7 million in expenditures related to the same race. Political organizations on both sides have reported tens of millions spent to influence Ohio voters ahead of the midterms.

Recent filings show that Fairshake and Digital Freedom Fund invested heavily in Ohio’s Senate race, with Fairshake spending $56 million and Digital Freedom Fund allocating over $7 million on media campaigns.

With the FEC’s electronic filing system currently disrupted, investors and political observers face greater difficulty tracking timely spending updates from major crypto-aligned PACs. During periods of heightened electoral activity, real-time data becomes especially important.
