The Massachusetts Senate has voted to prohibit cryptocurrency ATMs, attaching the measure to a comprehensive economic development bill. Lawmakers took action in response to mounting concerns about widespread scams tied to these kiosks, with the FBI reporting nearly $7 million in losses across the state last year.

Spiking fraud prompts legislative crackdown

Crypto ATMs are installed in hundreds of Massachusetts locations, including convenience stores, pharmacies, and liquor stores. These machines allow users to convert cash directly into cryptocurrency. The lack of regulation in the state has drawn criticism from consumer advocates, who say the kiosks have become tools for fraudsters targeting the elderly and other at-risk groups.

According to FBI data, Massachusetts residents filed 296 complaints related to kiosk scams in 2025, totaling $6,834,561 in reported losses. On average, this amounts to roughly $19,000 lost per day statewide. Nationwide, the bureau calculates $389 million has been stolen through such scams over the past year.

Norfolk County Sheriff Patrick McDermott described how scammers typically contact victims by phone or text, pressure them to move savings into Bitcoin, and then guide them step by step to deposit cash at a nearby crypto ATM. He stated that once the money is transferred through the machine, it quickly disappears into an anonymous wallet.

AARP Massachusetts, a division of the national nonprofit organization advocating for older Americans, strongly supported the ban. “A ban on crypto ATMs is now the most effective way to stop the ongoing damage,” state director Jen Benson stated on Thursday.

Lack of regulation draws operators to the state

Massachusetts currently has no written rules or regulations governing the operation of crypto kiosks. This regulatory gap makes the state an outlier in New England and has made it a target for kiosk operators seeking fewer restrictions.

In contrast, Vermont, Minnesota, Indiana, and Tennessee have implemented outright bans on crypto ATMs, while 28 other states have introduced various restrictions to mitigate fraud and protect consumers.

Sheriff McDermott emphasized that with no local guardrails in place, removing the machines is the only immediate tool available to combat rising scam activity until permanent regulation can be established.

The Senate included the crypto ATM ban as an amendment to its economic development package, approving the legislation late Thursday night. However, the measure’s success is uncertain. Similar language appeared in previous House legislation and budget proposals but failed to advance during negotiation.

Moving forward, the fate of the kiosk ban will depend on whether the Senate and House can reconcile differences in their bills and pass a unified version. If the ban survives the final version, Massachusetts would join a growing list of states imposing strict controls on cryptocurrency kiosks to protect consumers.

The future of the proposed crypto ATM ban remains uncertain, hinging on collaboration between the Massachusetts Senate and House to finalize economic policy this session.
