SEC and CFTC advance crypto regulations as Senate blocks market clarity bill

The Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) are moving forward with their own regulatory initiatives for digital assets after the U.S. Senate failed to pass the Digital Asset Market Clarity Act (H.R. 3633). The bill fell one vote short in a 49–50 decision on September 15, stalling in the face of partisan disagreements over official crypto holdings and stablecoin oversight.

Senate deadlock fuels agency action

The lack of legislative progress has left the cryptocurrency industry without clear rules ahead of the November midterm elections. In response, the SEC and CFTC signaled plans to use administrative measures to fill this regulatory gap and provide market participants with guidance.

Rather than waiting for a breakthrough in Congress, both agencies have intensified their own rulemaking efforts. The SEC is pushing ahead with a proposed Regulation Crypto Assets, which seeks to offer flexible registration exemptions for crypto startups subject to $5 million and $75 million thresholds. Public hearings for this proposal will run through October 20.

A shift in tone has emerged within the SEC, with Commissioner Hester Peirce characterizing past enforcement-focused strategies as overly paternalistic, suggesting a new openness to alternative regulatory paths.

Commissioner Hester Peirce has described previous rigid enforcement approaches as “infantilizing investors,” signaling a changing attitude within the SEC toward more adaptable oversight.

At the CFTC, Chairman Michael Selig confirmed that the agency is using its current authority to shape market structure. The CFTC has updated its rules to account for tokenized assets and submitted a detailed regulatory proposal to the White House for review.

These regulatory actions are being coordinated via an interagency agreement that organizes digital assets into five categories, including digital commodities and securities.

Crypto groups shift strategies, price stability holds

The failure of the clarity bill has triggered leadership changes among industry groups. Blockchain Association CEO Summer Mersinger will step down on October 16, with Kristin Smith set to assume her role.

Meanwhile, leading crypto companies are taking a more proactive approach in Washington. Coinbase CEO Brian Armstrong and the Stand With Crypto alliance have launched a voter outreach initiative, framing fintech development as a bipartisan national security concern.

With regulators signaling readiness to provide guidance, financial markets have responded with steady sentiment. Bitcoin is holding firm between $84,000 and $86,000, reflecting confidence that agency rules may offer more reliable clarity than congressional action in the near term.

Major altcoins such as XRP and NEAR are also trading close to local highs. Investors are watching for further regulatory developments, hoping for smoother, faster guidance from the agencies than from a divided legislature.
